CUEDEV LLC ("CUEDEV", "we", "us", or "our") respects the intellectual property rights of others and expects the users of SOXLayer and soxlayer.com (together, the "Service") to do the same. SOXLayer is a product of CUEDEV LLC.
This policy explains how we respond to claims of copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"). It forms part of our Terms and Conditions.
1. Scope
This policy applies to content made available through the Service, including content on soxlayer.com and files, documents, and other material uploaded to SOXLayer by our customers and their users ("User Content").
Most User Content in SOXLayer is private to the customer organization that uploaded it and is not publicly accessible. We still respond to valid notices concerning any content stored on or made available through the Service.
2. Designated copyright agent
Send all notices of claimed infringement and counter-notifications to our designated agent:
DMCA Agent
CUEDEV LLC
30 N Gould St, Ste R
Sheridan, WY 82801
United States
Email: team@soxlayer.com
Subject line: DMCA Notice
Only copyright-related notices should be sent to this agent. Other inquiries sent to this address in a DMCA notice may not receive a response.
3. Filing a notice of infringement
If you believe that content available through the Service infringes a copyright you own or are authorized to enforce, send our designated agent a written notice that includes all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work claimed to be infringed, or, if multiple works are covered by one notice, a representative list of those works.
- Identification of the material claimed to be infringing, with enough information for us to locate it, such as the URL, file name, or a description of where it appears in the Service.
- Your contact information, including your name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
Notices that do not substantially meet these requirements may not be acted upon.
4. What we do after receiving a valid notice
When we receive a notice that substantially complies with Section 3, we will:
- Remove or disable access to the material identified in the notice, acting expeditiously.
- Make reasonable efforts to notify the customer account and user who uploaded the material, and provide them with a copy of the notice.
- Inform them of their right to submit a counter-notification under Section 5.
Because SOXLayer handles confidential customer records, we will limit access to the affected material to what is necessary to process the notice.
5. Filing a counter-notification
If you believe material you uploaded was removed or disabled by mistake or misidentification, you may send our designated agent a written counter-notification that includes all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and the location where it appeared before it was removed or disabled.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, any judicial district in which CUEDEV may be found, and that you will accept service of process from the person who filed the original notice or that person's agent.
6. What we do after receiving a valid counter-notification
When we receive a counter-notification that substantially complies with Section 5, we will:
- Promptly send a copy of the counter-notification to the person who filed the original notice.
- Inform that person that we will restore the removed material or stop disabling access to it in 10 business days.
- Restore the material or stop disabling access to it no less than 10 and no more than 14 business days after receiving the counter-notification, unless our designated agent first receives notice that the original complainant has filed a court action seeking to restrain the user from engaging in infringing activity relating to the material.
7. Repeat infringers
It is our policy to terminate, in appropriate circumstances, the accounts of users and customers who are repeat infringers. We may also limit access to the Service or terminate accounts of anyone who infringes the intellectual property rights of others, whether or not there is repeat infringement, in our sole discretion.
8. Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Before submitting a notice or counter-notification, consider whether the use may be authorized, such as by license or fair use. If you are unsure whether material infringes your copyright, consult a lawyer before filing a notice.
9. Other intellectual property concerns
For trademark or other intellectual property concerns that are not copyright claims, contact us at team@soxlayer.com with a description of the issue. We will review and respond as appropriate.
10. Changes to this policy
We may update this DMCA Policy from time to time. Changes take effect when posted on soxlayer.com, and the "Last updated" date above will be revised.
